1. Introduction

Welcome to Sabzi ("App"). This App is operated by Root Node Pty Ltd ("Company", "we", "us", or "our"), a company registered in Australia.

By downloading, accessing, or using the App, you ("User", "you") agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, you must strictly stop using the App and uninstall it immediately.

2. Accounts

2.1. Account Creation: To use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

2.2. Security: You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2.3. Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms.

3. Subscriptions and Purchases

The App offers digital goods and subscription services ("Paid Services").

3.1. Subscriptions:

• Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select.
• Auto-Renewal: Your Subscription will automatically renew at the end of each billing cycle unless you cancel it or we cancel it.
• Free Trials: We may, at our sole discretion, offer a Subscription with a free trial for a limited period of time. You may be required to enter your billing information in order to sign up for the free trial. If you do not cancel your Subscription before the trial period ends, you will be automatically charged the applicable Subscription fees.

3.2. One-Time Purchases:

We may offer specific goods or lifetime access passes for a one-time fee. These purchases are non-recurring.

3.3. Payments and Refunds:

• Processing: All payments are processed through third-party application stores (e.g., Apple App Store, Google Play Store). We do not store or collect your payment card details.
• Refunds: Refund requests must be made directly to the Application Store through which you made the purchase (Apple or Google). These stores have their own refund policies, and we do not have the ability to process refunds directly.

3.4. Apple Device Terms:

If you are accessing the App via an Apple device, the following terms apply:

• Payment will be charged to your Apple ID account at the confirmation of purchase.
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.

4. Intellectual Property

The App and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Root Node Pty Ltd and its licensors. The App is protected by copyright, trademark, and other laws of both Australia and foreign countries.

5. User Feedback

We welcome feedback, comments, and suggestions for improvements to the App ("Feedback"). You acknowledge and agree that if you submit Feedback to us, we may use, disclose, reproduce, and exploit such Feedback without restriction and without any compensation or credit to you.

6. Promotions and Contests

Any contests, sweepstakes, or other promotions (collectively, "Promotions") made available through the App may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

7. Prohibited Uses

You agree not to use the App:

• In any way that violates any applicable national or international law or regulation.
• To attempt to reverse engineer, decompile, hack, disable, interfere with, disassemble, copy, or disrupt the integrity or the performance of the App.
• To transmit specific unsolicited advertising or promotional material ("spam").

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Root Node Pty Ltd, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App;
• Any conduct or content of any third party on the App;
• Any content obtained from the App; and
• Unauthorized access, use, or alteration of your transmissions or content.

Australian Consumer Law (ACL):
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010) cannot be excluded, restricted, or modified. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

9. Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
